1. Acceptance of Terms

By creating an account on SharpReach, you agree to these Terms of Service in full. If you do not agree with any part of these terms, you may not use the platform.

2. Service Description

SharpReach is a B2B cold email outreach automation platform providing tools for lead management, email campaigns, WhatsApp outreach, CRM, and AI-powered personalization. The platform is intended for business-to-business (B2B) outreach only.

3. Data You Upload

• You retain full ownership of all data you upload, including leads, contacts, and email lists.
• You confirm that this data was collected lawfully and that recipients have a legitimate business interest.
• You are solely responsible for compliance with CAN-SPAM, GDPR, CASL, and all applicable email laws in your target markets.
• SharpReach is not liable for how you use the outreach tools provided.

4. Platform Access to Your Data

SharpReach may access your account data strictly for the following purposes:

• Technical support when you request it
• Billing verification and dispute resolution
• Legal compliance and fraud prevention
• Platform security and abuse prevention
• Processing GDPR or data deletion requests

All administrative access to your data is logged with a timestamp and reason for compliance purposes.

5. Prohibited Uses

You may not use SharpReach to:

• Send spam or unsolicited emails to individual consumers (B2C cold email)
• Harass, threaten, or abuse email recipients
• Upload data obtained illegally or without a legitimate business basis
• Promote illegal products, services, or content
• Violate CAN-SPAM, GDPR, CASL, or any other applicable law
• Create multiple accounts to abuse the free trial period

Violation of any of the above results in immediate account suspension without refund. Repeated or severe violations may result in a permanent ban of all associated accounts, email addresses, and payment methods.

6. Billing & Cancellation

• Subscriptions are billed monthly, quarterly, or yearly as selected at signup.
• A 7-day free trial is provided so you can evaluate the platform before committing.
• All sales are final. No refunds are provided after payment is processed.
• You may cancel your subscription at any time. Cancellation stops future billing but does not refund the current period.
• Agency plan requires a minimum of 3 seats.
• We reserve the right to change pricing with 30 days notice via email.

7. Data Security

• All data is encrypted at rest and in transit (HTTPS/TLS).
• Passwords are hashed using bcrypt — we cannot see your password.
• API credentials and SMTP passwords are encrypted using Fernet encryption.
• We maintain audit logs of all administrative access to your data.
• In case of a data breach affecting your account, we will notify you within 72 hours.

8. Your Right to Data Deletion

You may request deletion of your account and all associated data at any time by emailing support@sharpreach.online. We will process all deletion requests within 30 days.

9. Abuse & Complaints

Recipients who receive unwanted emails from SharpReach users may report abuse to support@sharpreach.online. We investigate all complaints within 24 hours. Verified violations result in immediate account suspension. SharpReach maintains sending logs for 90 days for abuse investigation purposes.

Every email sent through SharpReach includes a functional unsubscribe link. Users who ignore unsubscribe requests will have their accounts suspended.

10. Uptime & Liability

• We target 99.5% uptime but do not guarantee uninterrupted service.
• SharpReach is not liable for lost business, lost leads, or campaign failures.
• Our maximum liability is limited to the amount you paid in the last 30 days.

11. Account Termination

• You may cancel your account at any time from account settings.
• We may terminate accounts that violate these terms without prior notice.
• Upon termination, your data will be permanently deleted within 30 days.

12. Governing Law

These Terms of Service are governed by the laws of England & Wales (United Kingdom). Any disputes will be resolved in UK courts.

13. Changes to These Terms

We may update these terms at any time. We will provide at least 14 days notice via email before changes take effect. Continued use of the platform after that date constitutes acceptance of the updated terms.
